A disputed will may raise questions about capacity, undue influence, execution, or whether a later document controls. Disappointment with an inheritance alone does not establish a valid contest. We represent clients challenging a will and clients defending its validity, subject to the engagement and conflicts review.
Evaluate the document and the circumstances
The will, earlier versions, witness information, and records surrounding its preparation and signing can be important. The relevant evidence depends on the asserted ground. We distinguish a concern about an outcome from facts that may support a legal challenge.
Address the probate proceeding
We review what has been filed, whether an order has been entered, who has standing, and what relief is sought. Timing matters and different deadlines may apply to different circumstances. We prepare the claim or defense and seek the records needed for the contested proceeding.
Records that may matter
- The disputed will, codicils, and available earlier versions
- Probate application, orders, notices, and hearing information
- Witness details and relevant communications or capacity records
Questions about your case
Does an unequal inheritance prove undue influence?
No. The asserted ground requires supporting evidence. An unexpected or unequal distribution alone does not establish that a will is invalid.
Is a will contest the same as a complaint about the executor?
No. Validity of the will and conduct in administering an estate are distinct issues, although both may arise in one estate.
